Box 2648 Houston, Texas 77252-2648 Attention:Joan Weessies, Director Economic Regulation and Tariff Services Reference:Request for Waiver of FERC Form No. 6 Filing Requirements Ladies and Gentlemen: On March 1, 2004, Mars Oil Pipeline Company (Mars) filed a letter requesting a waiver of 18 C.F.R. * 357.2, FERC Form No. 6, Annual Report of Oil Pipeline Companies. Mars indicates that in past orders, the Commission stated that it lacks jurisdiction under the Interstate Commerce Act (ICA) to regulate oil pipelines located wholly on the Outer Continental Shelf (OCS). Mars contends that it is an oil pipeline located wholly on the OCS, and is exempt from jurisdiction under the ICA. In order to assist the Commission in determining the appropriate course of action on your request for waiver, additional information is required. Accordingly, within five business (5) days of the date of this data request, Mars must file a response to each question listed in the Attachment. McLaughlin, Director Division of Tariffs and Market Enclosure Development - Central Attachment Mars Oil Pipeline Company Data Request Applicable to Non-Jurisdictional Status On March 1, 2004, in Docket No. IS04-214-001, Mars requested waiver of the requirement to file FERC Form No. 6 for the 12- month reporting period ending December 31, 2003, the first quarter of 2004 and thereafter. Mars states its pipeline originates at Mississippi Canyon Block 807, with barrels solely destined for transportation to the Federal State Water Line (FSWL) located Offshore Louisiana. Mars contends that it will transport crude oil from the FSWL on Mars tariffs on file and in effect in Louisiana, LPSC No. 2. Mars believes its transportation from Block 807 to FSWL is within the jurisdiction of the OCS Lands Act, and transportation from the FSWL to Clovelly and Fourchon in Lafourche Parish, Louisiana are on file with the Louisiana Public Service Commission. On March 1, 2004, in Docket No. IS04-214-000, Mars filed supplements to cancel F.E.R.C. Nos. 16, 17, 19, 22, and 23, effective April 1, 2004, in accordance with Bonito Pipe Line Co.[1] Mars states that it transports crude petroleum from Mississippi Canyon Block 807 on the OCS to the FSWL located at Block 4, ...
