P R O C E E D I N G S PRESIDING JUDGE: We can go on the record. I have from Kern River notification that witness MacLennan -- MR. THOMPSON: MacLennan. PRESIDING JUDGE: MacLennan is not available, and he did send notice to all of you. I understand from Mr. Sundback that this was a hardfought order of witnesses. Nevertheless, if hes out of the country, hes out of the country, and were here, Kern River has substituted somebody, and were going to move on. MR. THOMPSON: Your Honor, may I raise one other preliminary matter? PRESIDING JUDGE: Yes, you may. MR. THOMPSON: You may recall yesterday morning, your Honor, we had a discussion about the Questar witness and having a mutual waiver of cross-examination. PRESIDING JUDGE: Yes. MR. THOMPSON: And one of the conditions on that was that Kern River would introduce by stipulation certain responses to data requests by Questar to Kern River, and I have those prepared as an exhibit and Im prepared to offer them at this time if you please. PRESIDING JUDGE: Thats fine. And they are Kern River exhibits. MR. THOMPSON: Yeah, this is one Kern River exhibit consisting of responses by Questar to certain data requests of Kern River in this proceeding. PRESIDING JUDGE: And its number will be -- MR. THOMPSON: I believe it is KR-114, your Honor. PRESIDING JUDGE: Thats correct. KR-114? MR. THOMPSON: Yes. And your Honor, Ill hand one copy to you and I have two for the reporter.
