In accord with 18 C.F.R. 385.1006 of the Federal Energy Regulatory Commissions (Commission) regulations, Vaughn hereby requests a hearing on this matter. Vaughn also requests that the Commission act expeditiously in this matter. The Department of Energy (DOE) standards that Vaughn is seeking relief are currently in effect and have been since April 16, 2015. On November 21, 2014, Vaughn filed its application for exception seeking relief from the serious hardship, gross inequity, or unfair distribution of burdens imposed by DOEs Final Rule with the Office of Hearings and Appeals (OHA). Vaughn received a decision from OHA denying its application on April 09, 2015. The potential effect of recently enacted legislation is unclear and Vaughn seeks certainty through this Petition to allow it to make appropriate business plans. Vaughn therefore respectfully requests that the Commission expeditiously designate a presiding officer as required by 18 C.F.R. 385.1004(d) and order the prompt convening of a prehearing conference. Vaughn also requests that the record be certified pursuant to 18 C.F.R. 385.1010 so that the Commission can consider a final order at the Commissions next regularly scheduled meeting.
