Bose, Secretary Federal Energy Regulatory Commission 888 First Street, NE Washington, DC 20426 Re: Texas Eastern Transmission, LP, Docket No. RP12-____-000 Dear Ms. Bose: Pursuant to Section 4 of the Natural Gas Act1 and Part 154 of the regulations of the Federal Energy Regulatory Commission (FERC or Commission),2 Texas Eastern Transmission, LP (Texas Eastern) hereby submits for filing as part of its FERC Gas Tariff, Eighth Revised Volume No. 1 (Tariff) and its FERC Gas Tariff, Filed Agreements (Filed Agreements Tariff), the tariff records listed in Appendix A to be effective July 1, 2012. Texas Eastern requests that the Commission issue an order on or before June 28, 2012 accepting this filing to ensure that this filing is accepted by the closing date of the transaction referenced herein, which transaction may close as early as June 29, 2012. STATEMENT OF NATURE, REASONS, AND BASIS Background Information On October 31, 2011, Entergy Arkansas, Inc. (Entergy Arkansas) and KGen Hot Spring LLC (KGen Hot Spring) filed a request for a temporary waiver (Petition) of certain of the Commissions capacity release regulations and policies, as well as temporary waiver of the affected interstate pipelines tariff provisions implementing the Commissions capacity release regulations, including Texas Easterns, in order to facilitate the prearranged permanent release of firm natural gas transportation agreements from KGen Hot Spring to Entergy Arkansas due to Entergy Arkansas purchase of KGen Hot Springs electric generation facility. By order issued on January 30, 2012 in Docket No. RP12-79-000,3 the Commission granted the Petition for a period of 90 days beginning on the closing date of the transaction between Entergy Arkansas and KGen Hot Spring. Texas Eastern and KGen Hot Spring entered into a precedent agreement and certain transportation agreements in order for Texas Eastern to provide service to KGen Hot Spring on the lateral Texas Eastern recently constructed and placed into service to serve KGen Hot 1 15 U.S.C. 717c (2006). 2 18 C.F.R.
