Mr. Ekzarkhov concludes that El Pasos compliance rates improperly include costs of unsubscribed or discounted pre-1996 Settlement capacity and should be reduced. He then calculates appropriate Article 11.2(b) rates using billing determinants that are based on the minimum presumed threshold of 4,068,000 Dth per day. Mr. Ekzarkhov calculates these rates for three rate periods used in El Pasos compliance filing. Mr. Ekzarkhov explains why the rate calculation differs for the three periods. Finally, Mr. Ekzarkhov calculates the revenue impacts of the reduced Article 11.2(b) rates for each of the three rate periods.
