DESCRIPTION OF REQUESTING PARTY AND THE FACILITIES Brigham Exploration Company (Brigham Exploration) is the holding company and a limited partner in Brigham Oil & Gas. Brigham Inc., a subsidiary of Brigham Exploration, is the general partner and also the only other limited partner in Brigham Oil & Gas. Brigham Oil & Gas owns and operates gathering pipeline assets in North Dakota that are the subject of the instant waiver application. In December 2011, Statoil ASA (Statoil), through a stock transaction, acquired a 100% ownership interest in Brigham Exploration. Statoil is a corporation registered under the laws of the Kingdom of Norway. Shares of Statoil are traded on the Oslo stock exchange, and Statoil American Depository Receipts are traded on the New York Stock Exchange. Statoil has numerous affiliates that operate in the United States, including Statoil North America, Inc. and Statoil Marketing & Trading (US) Inc. (Statoil Marketing & Trading). With the purchase of Brigham Exploration, Statoil acquired Brigham Oil & Gas and its various exploration and production assets, including three oil pipeline gathering systems located in North Dakota (herein the Brigham Pipelines). To date, the Brigham Pipelines and related terminals are in various stages of construction and partial operation. These three systems 2 are (1) the Williams System; (2) the McKenzie System and (3) the Ross System. Each oil pipeline gathering system is located wholly within the state of North Dakota. Each system will collect oil produced from the wells located along the pipeline routes, and transport such oil to a receiving terminal for further transportation to interstate destinations either via interstate oil pipelines or railroad systems. The oil that is transported on the Brigham Pipelines will be entirely owned by Brigham Oil & Gas and/or Statoil Marketing & Trading, an affiliate of Brigham Oil & Gas.
