Windy Hill respectfully requests that the Commission grant approval of these temporary acts by August 1, 2004, so that Windy Hill can conduct subsurface feasibility testing to gain necessary information on a timely basis, allowing it to continue with its development schedule and to submit its certificate application for the planned storage facility in a timely fashion. The requested approval date coincides with anticipated state approval of Windy Hilrs drilling application, and will allow Windy Hill to contact for the required drilling equipment to perform the required subsurface testing just in advance of the traditional peak drilling pedod in the Rockies from September to March, during which period rig availability is limited. Failure to conduct the planned drilling at that time could result in significant delays in the project due to the great demand for dgs in the region, particularly later in the year.
