Smith of Wickwire Gavin, P.C. submitted a request under the Commissions critical energy infrastructure information (CEII) regulations at 18 C.F.R. * 388.113(d)(3) (2003) for documents related to the Silver Lake Project, P-10855. Mr. Smith submitted his request on behalf of his client MWH, Inc., the designer of the fuse plug installed at the Silver Lake Project, which is owned by the Wisconsin Public Service Corp. (WPSC). By letter dated August 15, 2003, Susan Court, Associate General Counsel for General and Administrative Law notified David Harpole of WPSC, the submitter of the requested information, of the request, and provided WPSC with ten (10) calendar days in which to comment on the request. On August 26, 2003, staff contacted the WPSC, and Alyse Stackhouse, an attorney from WPSC, indicated that they did not have a problem with the Commission releasing the documents to Mr. Smith. 2. CEII is defined in 18 C.F.R. * 388.113(c)(1)as "information about proposed or existing critical infrastructure that (i) relates to the production, generation, transportation, transmission, or distribution of energy; (ii) could be useful to a person in planning an attack on critical infrastructure; (iii) is exempt from mandatory disclosure under the Freedom of Information Act [FOIA], 5 U.S.C. 552; and (iv) does not simply give the location of the critical infrastructure." The documents Mr. Smith requested were provided by WPSC to the Commission after the failure of the Silver Lake dam. The documents include detailed design data, specifications, construction records, operation information, and stability information relating to the Silver Lake Project. The documents qualify as CEII ...
