Washington, DC 20426 EXPEDITED CONSIDERATION REQUESTED REQUEST FOR JURISDICTIONAL DETERMINATION, OR TEMPORARY WAIVER Dear Ms. Bose: Kenai Pipe Line Company (KPL), Tesoro Alaska Company (Tesoro Alaska), and Tesoro Logistics Operations, LLC (TLO) (collectively, Tesoro) hereby submit a Request for Jurisdictional Determination, or, in the Alternative, Temporary Waiver of Tariff Filing and Reporting Requirements. This filing is made in compliance with the provisions of the Interstate Commerce Act (ICA) and the Rules and Regulations of the Federal Energy Regulatory Commission (FERC or Commission), specifically Rule 204 of the Rules of Practice and Procedure of the FERC, 18 C.F.R. 385.204 (2009). In its Request, Tesoro asks that the Commission determine that two crude oil pipelines and several crude oil and refined products spur lines that are part of Tesoros internal refinery operations are not subject to the Commissions jurisdiction under the ICA. Tesoro also requests that the Commission determine that a dock and tank storage that Tesoro also uses as part of its internal refinery operation are not subject to the Commissions jurisdiction. In the alternative, Tesoro asks that the Commission grant a temporary waiver of ICA Section 6 and Section 20 tariff filing and reporting requirements for these facilities. The pipelines and pipeline spurs are ultimately owned by Tesoro Alaska, but are intended for transfer to its affiliate, TLO. The pipeline spurs are involved in an arrangement for the formation of a Master Limited Partnership (MLP) and the transfer of assets to that MLP.
